TELCONTAR PRIVACY POLICY

FOR THE TELEVOKE UNIVERSAL TELEMATICS SERVICE

Telcontar’s Televoke Universal Telematics Service offers mobile safety, security and convenience applications.  This Privacy Policy addresses the collection, use and disclosure of information by Telcontar through the Televoke Universal Telematics Server™ product and related services (“Televoke”).  This Privacy Policy is available on the Telcontar website at http://www.telcontar.com. This Privacy Policy may be updated from time to time as our services change and expand, and such changes will be posted on our website.

 

WHAT DOES TELCONTAR DO?

 Telcontar provides fully automated web and telephony service platforms with a diverse set of applications that enable Telcontar customers to provide notification, tracking, and control of commercial and personal assets, including automobiles, computers and other valuable items, services (“Telematics Services”) to end-users.

 

TELCONTAR AND YOU

 Telematics Services are typically provided directly to our customers (“Televoke Customers”), who in turn offer these services to either resellers or consumers and end-users (“End-Users”).  In connection with Televoke Customers’ offering of Telematics Services to End-Users, Telcontar will receive personal information from or on behalf of the Televoke Customer about End-Users.  Personal information means any information that identifies, or may be used to identify, an individual person.  For this reason, Telcontar asks that Televoke Customers disclose their relationship with us by providing notice to End-Users about the Televoke Universal Telematics Service, as well as a link to this Privacy Policy. 

 

FROM WHOM DOES TELCONTAR GATHER INFORMATION AND HOW?

 Telcontar gathers, receives or maintains both personal information and other identifying data regarding End-Users from several sources: 

  • Customers.  Most personal information we receive is from, through, or on behalf of Televoke Customers from whom End-Users have purchased Telematics Services. This information may be provided via the Internet through a Televoke Customer’s website, by facsimile, by email, via voice user interface, or through a Televoke Customer’s telephone call center. 
  • End-Users.  In some cases, information may be collected directly from the End-User.
  • Telematics Devices.  Tracking and location information may also be received from Telematics Devices that work in conjunction with the Telematics Services.
  • Data Generated in Conjunction with Service.  Telcontar may also use and maintain data generated in conjunction with the Telematics Services, such as latitude and longitude information of devices and End-User assets.

 

WHAT PERSONAL INFORMATION DOES TELCONTAR RECEIVE?

Telcontar may collect, receive and/or maintain the following personal information:

·        Name

·        Address

·        Telephone Numbers (which may include work, home or other phone numbers)

·        Email Address

·        Password or other authentication information

·        Time Zone

·        Security Question and Answer

In connection with Telematics Services used for automobile tracking, Telcontar may also collect, receive and/or maintain vehicle make, model, license plate number, vehicle identification number, or color of the automobile.

And in connection with some additional services that require this information, Telcontar may also collect, receive and/or maintain, from or on behalf of Televoke Customers, other information relating to the End-User such as Social Security numbers, blood type, emergency contact information, doctor’s name and telephone number, allergies, primary and secondary drivers for automobiles, etc.

Telcontar may also collect, receive or maintain billing information, which can include credit card numbers, the name on the account, other billing or customer activation codes, and other transaction related information.  However, credit card numbers are not stored on the Televoke system, and are used by third party billing services for payment purposes only.

Finally, in connection with the Telematics Services, tracking and location information may be collected, received or maintained by Telcontar in connection with each account according to the type or level of services the Televoke Customer or End-User has selected.  Other product specific information, such as automobile engine or door status and control, may also be collected.

 

HOW DOES TELCONTAR USE THE INFORMATION IT RECEIVES?

 Telcontar uses the information it receives to deliver the Telematics Services, including completing transactions, initiating and maintaining user accounts, and tracking or locating assets or initiating other actions requested by End-Users.  Telcontar may use contact information, such as your telephone number and e-mail address, to contact you regarding account status, changes to our products and services, to confirm registration or to address transaction or billing issues that may arise.  Televoke Database Administrators, or Televoke Customer’s or Televoke’s customer service representatives, selected developers and system administrators may have access to personal information in order to provide or maintain the Telematics Services, including but not limited to for purposes of testing, diagnostics, program fixes, and the like.

 

TO WHOM DOES TELCONTAR DISCLOSE INFORMATION?

 Telcontar does not sell, transfer or disclose to third parties the personal information it receives, except under the following circumstances:

·        Telcontar may disclose, or may allow access to, personal information to the Televoke Customer from whom the End-User purchased the Telematics Services, or to that Televoke Customer’s authorized agents.   To learn more about how Televoke Customers collect, use or disclose information about End-Users, please refer to the privacy policy of the Televoke Customer from whom you purchased the Telematics Services.

·        Telcontar may provide information to End-Users who contact a Televoke Customer Service Representative by emailing privacy@telcontar.com.  The Customer Service Representative may give account information to End-Users who provide appropriate information identifying themselves as eligible to receive such information.  You should not share account information, such as specific contact information or passwords, with anyone you do not want to have access to account information.

·        Telcontar may use or disclose information to others as requested by the Televoke Customer or End-User.

·        Telcontar uses third-parties to assist it in the maintenance and operation of its products and services, such as billing services, telecommunications service providers, etc., and may share information with such third parties for those purposes. 

·        Telcontar may disclose information when required by law or under the good-faith belief that such disclosure is necessary in order to conform to applicable law, comply with legal process served on Telcontar, or to protect the property or interests of Telcontar, its agents and employees, personal safety, or the public.  Under such circumstances, Telcontar may be prohibited by law, court order or other legal process from providing notice of the disclosure, and Telcontar reserves the right to not provide such notice in its sole discretion.

·        As its business evolves, Telcontar may sell, transfer or otherwise share some or all of its assets, including personally identifiable information, in connection with a merger, reorganization, or sale of assets, or in the event of bankruptcy.  In such an event, identifying, tracking or locating information may be one of the assets transferred.

 

CAN YOU ACCESS INFORMATION IN YOUR ACCOUNT?

End-Users may make requests for access and/or changes to their personal information by contacting the Televoke Customer from whom they purchased Telematics Services.  End-Users who are unable to contact the Televoke Customer from whom they purchased Telematics Services may email privacy@telcontar.com.

 

DOES TELCONTAR PROVIDE SECURITY FOR INFORMATION COLLECTED?

Telcontar maintains safeguards designed to protect the security of all the personal information that it maintains. Telcontar has physical and electronic security measures in place designed to prevent the loss, misuse, and alteration of personal information under its control.
